You won't get charged with identity theft. A court ruled that an illegal alien using someone elses SSN cannot be charged with ID theft because they didn't "knowingly" take that persons ID. So just claim the same thing. You didn't know who's ID you were stealing. If that defense is good enough for an illegal invading criminal, it's good enough for you.
